HIPAA: Health Insurance Portability and Accountability Act:

Standards and requirements developed by the Department of Health and Human Services for the maintenance and transmission of health information that identifies individual patients.

Applies to any business who has access to, or, are processing individually identifiable health information.

All individually indentifiable healthcare information processed by any business entity must be proactively safeguarded.

GLB: Gramm-Leach-Bliley Act:

Places significant restrictions on the use of customer information by those in the financial industry.

Requires companies that are engaged in financial activities to ensure the security and confidentially of their customers non-public information, such as, Social Security numbers, Account numbers, Credit Card numbers, applications, etc.

Sarbanes-Oxley Act:

Makes it a criminal offense to destroy corporate records because of a pending investigation.

Having a destruction policy in place would help protect a company from charges that it destroyed documents to avoid liability.

Wisconsin Act 9(Section 895.505):

Requires the covered businesses that possess personal financial or medical information to properly dispose of client or patient records.

One of the Disposal Requirements is that a business may not dispose of a record containing personal information unless it “shreds the record”.
